Annex I
Model information notice on warranty for defects
1. Warranty for defects
In what cases can you exercise your right under the warranty for defects?
In the event of defective performance by OM Education & Consulting Kft., you may assert a warranty claim against the business in accordance with the rules of the Civil Code.
What rights do you have under a warranty claim?
You may – at your choice – assert the following warranty claims:
You may request repair or replacement, unless fulfilling the claim you have chosen is impossible or would involve disproportionate additional costs for the business compared with fulfilling another claim. If you did not or could not request repair or replacement, you may request a proportionate reduction of the consideration, or you may repair the defect yourself or have it repaired by someone else at the expense of the business, or – as a last resort – you may withdraw from the contract. In the case of a contract between a consumer and a business for the sale of goods qualifying as movable property, the supply of digital content or the provision of digital services, when exercising your warranty rights you may not repair the defect yourself or have it repaired by someone else at the expense of the business. You may switch from the warranty right you have chosen to another one, but you bear the cost of switching, unless it was justified or the business gave cause for it.
Within what time limit can you assert your warranty claim?
You are obliged to notify the defect without delay after discovering it, and in the case of Consumers no later than two months from the discovery of the defect. However, please note that in the case of Consumers you can no longer assert your warranty rights beyond the two-year limitation period from the performance of the contract, and in the case of other Customers beyond a one-year period.
Against whom can you assert your warranty claim?
You can assert your warranty claim against the business.
What other conditions apply to asserting your warranty rights?
Within one year of performance, there is no condition for asserting your warranty claim other than notifying the defect, provided that you prove that the product or service was provided by OM Education & Consulting Kft..
2. Product warranty
Product warranty is available only to Customers who qualify as Consumers under the Civil Code.
In what cases can you exercise your right under the product warranty?
In the event of a defect in a product, you may – at your choice – assert the right set out in point 1 or a product warranty claim in accordance with the rules of the Civil Code.
What rights do you have under a product warranty claim?
As a product warranty claim, you may request the repair or replacement of the defective product.
Against whom can you assert your product warranty claim?
You may exercise your product warranty rights against the manufacturer or distributor of the product (hereinafter together: manufacturer).
In what cases is the product considered defective?
The product is defective if it does not meet the quality requirements in force at the time it was placed on the market, or if it does not have the characteristics set out in the description given by the manufacturer.
Within what time limit can you assert your product warranty claim?
The defect must be notified to the manufacturer without delay after it is discovered; a defect notified within 2 months is deemed to have been notified without delay. You may assert your product warranty claim within two years of the product being placed on the market by the manufacturer. After this period you lose this right.
In what cases is the manufacturer released from its product warranty obligation?
The manufacturer is released from its product warranty obligation if it can prove that
– it did not manufacture or place the product on the market in the course of its business activity, or
– the defect could not be detected according to the state of science and technology at the time the product was placed on the market, or
– the defect of the product results from the application of legislation or a mandatory regulatory requirement. To be released, it is sufficient for the manufacturer to prove one ground.
Please note that, for the same defect, you may assert a warranty claim against the business and a product warranty claim against the manufacturer at the same time, in parallel. If your product warranty claim is successfully asserted, you may thereafter assert your warranty claim relating to the replaced product, or to the repaired part of the product, only against the manufacturer.
Product warranty, guarantee
Under the legislation in force, neither product warranty nor guarantee applies to the service provided by the Provider.
